Workforce Alliance Selection Portal – Terms and Conditions Employers and Job Seekers of using the Workforce Alliance Selection Portal must agree to the following terms and conditions. Please read these conditions carefully. If you do not accept the Terms and Conditions stated here do not use the Workforce Alliance web site and service. By using this web site, you are indicating your acceptance to be bound by the terms and conditions. These conditions will serve as the entire agreement and will supersede all prior and contemporaneous communications, contracts, and understanding whether written or oral, express or implied with regard to this subject matter. Workforce Alliance may revise these terms and conditions at any time by updating this posting. You should visit this page periodically to review the terms and conditions because they are binding to you. Terms Individuals seeking employment may be referred to in this agreement and on the Workforce Alliance web site as “Job Seekers”, and “Applicant.” Companies seeking employees may be referred to in this agreement and on the Workforce Alliance web site as “Employers”, “Recruiters”, or “Clients”. Conditions It is the responsibility of Employers/Clients and Job Seekers to ensure they comply with all laws and legislations applicable in the country and state in which they conduct business and or reside. This is relevant to the creation of job advertising and custom application forms and online Job Seeker Information Records. Workforce Alliance will not accept any material or advertisements that appears to be contrary to law. You agree at all times to deal with any information or products provided by Workforce Alliance in a manner which strictly abides by all applicable laws of your county, state, country, or any other relevant jurisdiction (including, without limitation, privacy, employment, and copyright laws). All applicants who submit an Information Record for a position with Employer/Client during a job posting, and who follow the procedures for filing an application will be considered without preferential treatment or regard to race, creed, color, sex, national origin, Vietnam era, or disability status. Each applicant will be evaluated on merit, fitness and general qualifications for the advertised position. You agree to comply fully with the spirit and intent of all employment laws and the ADA. Employers/Clients warrants and covenants that any age, gender or ethnicity data and/or any other information provided as part of or in connection with an EEO Report provided by Workforce Alliance shall be used solely for reporting purposes and shall not be used by Employers/Clients in any employment-related decision. Employers/Clients warrants and covenants that its use of age, gender or ethnicity data and/or any other information provided as part of or in connection with an EEO Report shall be in compliance with all applicable laws, including without limitation, laws relating to labor and employment (including without limitation the U.S. Equal Employment Opportunity Commissions Uniform Guidelines on Employee Selection Procedures). Employers/Clients represents that it uses additional methods and media to increase its pool of diverse applicants and to provide notice of its employment opportunities to diverse applicants. Employers/Clients agrees that it shall defend, indemnify and hold harmless, Workforce Alliance, its affiliates and their respective directors, officers, employees and agents from and against third-party claims, actions or demands, including without limitation reasonable legal and accounting fees, arising or resulting from Employers/Client’s use of any age, gender or ethnicity data and/or EEO Reports provided hereunder. Job Seekers and Employers/Clients indemnify Workforce Alliance against all claims, actions, suits, liabilities, costs and expenses incurred on any account by Workforce Alliance as a result of the listing or intended listing of any advertisement or profile by that advertiser or job seeker on www.workforcealliance.com, or any related site. Workforce Alliance makes every effort to avoid errors in advertisements. However, Workforce Alliance accepts no responsibility or liability for any errors and requires that Employers/Clients and job seekers check their advertisements and profiles for errors as soon as they are placed on the site. Any errors may be edited immediately by contacting Workforce Alliance. Workforce Alliance reserves the right to either reject or remove any advertisement or profile from its site for any reason whatsoever. All users agree not to use the Workforce Alliance web site, for any of the following: Posting any franchise, pyramid scheme, "club membership", multi-level marketing, distributorship or sales representative agency arrangement or other business opportunity which requires an up front or periodic payment, pays commissions only (no significant salary) or requires recruitment of others including, but not limited to, members, sub-distributors or sub-agents. Employers/Clients should only place job ads for positions that are real and accurate and for which they have permission to recruit. Job Seekers agree to keep all information in your online profile up to date and accurate at all times. This includes your actual mailing address, phone numbers, email address, and information regarding your professional and work experience. Changes can be made to your profile at any time by logging into your account. You agree to keep Workforce Alliance and its associates fully indemnified against any actual or contingent liabilities incurred in relation to any actions or claims brought by any person against Workforce Alliance as a result of an actual or alleged breach by you of any law, or such other actions or claims brought in relation to the provision of services by Workforce Alliance to you. In no event will Workforce Alliance be liable for indirect, special, incidental, and consequential or exemplary damages. You may not assign or transfer your rights and obligations to any other person without Workforce Alliance’ prior written approval. If you are a Employer/Client, any change in the effective control of you shall be deemed an assignment for the purpose of this clause. The laws of the state of Louisiana, in the United States of America govern this agreement. You irrevocably and unconditionally submit to the non-exclusive jurisdiction of the Courts of Louisiana USA, and waive any objection to legal action being brought in those Courts on the grounds of venue or inconvenient forum. Workforce Alliance retains all intellectual property rights contained in any of the goods and services provided to you by Workforce Alliance, and you agree not to infringe any of Workforce Alliance' rights without prior written consent. Access to the Job Seeker Profiles (Information Records) is available only to Workforce Alliance clients who have paid and been approved by Workforce Alliance. Workforce Alliance clients may access Profiles solely for the purpose of identifying candidates whose work preferences, experience, work type, industry and occupation match the clients' current job vacancies. Using the Workforce Alliance Database for any purpose other than as an employer seeking employees, including but not limited to using the personal information on Resumes to sell or promote any products or services, collecting, storing, selling candidate contact information and other data. You will not send unsolicited mail or e-mail, make unsolicited phone calls or send unsolicited faxes regarding promotions and/or advertising of products or services to an applicant. You will not delete or revise any material posted by any other person or entity. You will not use any device, software or routine to interfere or attempt to interfere with the proper working of any Workforce Alliance/Todaro and Associates Site or any activity being conducted on this site. You will not take any action that imposes an unreasonable or disproportionately large load on any Workforce Alliance infrastructure. Notwithstanding anything to the contrary contained herein, using or attempting to use any engine, software, tool, agent or other device or mechanism (including without limitation browsers, spiders, robots, avatars or intelligent agents) to navigate or search any Workforce Alliance Site other than the search engine and search agents available from the Workforce Alliance. You will not attempt to decipher, decompile, disassemble or reverse engineer any of the software comprising or in any way making up a part of the Workforce Alliance Site. You will not aggregate, copy or duplicate in any manner any of the Web Site Content or information available from any part of the Workforce Alliance site. You will not frame or link to any of the Web Site Content or information available from any part of the Workforce Alliance site. You are responsible for maintaining the confidentiality of your information and password. You shall be responsible for all uses of your registration, whether or not authorized by you. You agree to immediately notify Workforce Alliance of any unauthorized use of your registration or password. You will not for any reason disclose or share your user ID or password with any third parties. WorkforceAlliance.com is only a venue. This Web Site acts as a venue for employers to post job opportunities and candidates to post information Records/resumes and does not screen or censor the listings offered. Workforce Alliance is often not involved in the actual transaction between employers and candidates. As a result, Workforce Alliance has no control over the quality, safety or legality of the jobs or resumes posted, the truth or accuracy of the listings, the ability of employers to offer job opportunities to candidates or the ability of candidates to fill job openings. In addition, note that there are risks, including but not limited to the risk of physical harm, of dealing with strangers, foreign nationals, underage persons or people acting under false pretenses. You assume all risks associated with dealing with other users with whom you come in contact through the Web Site.
